A 41-year-old high school teacher accused of having sex with a 15-year-old student has revealed that she’s pregnant. Heiry Calvi, 41, was taken into custody after the student reportedly showed his friends cellphone videos of the pair having sex. While she was released on Saturday after posting bond, she told police while in custody that she’s expecting a child, WSVN and CBS Miami report.
- Doral Police spokesperson Rey Valdes confirmed the pregnancy. Authorities say that Heiry Calvi revealed her condition during the intake process just after her arrest. However, neither Calvi’s attorney nor the woman herself has identified the father of the unborn child.
- The student claimed the sexual encounters were consensual. However, the problem of course is that a 15-year-old child does not have the legal right to consent to having sex with a 41-year-old adult. More than that, the adult here clearly groomed the student and abused her position of power. “A child does not have the legal authority to give consent even though the child may say ‘this is OK,'” Valdes previously told the Miami Herald. “The responsibility is on the adult.”
- Calvi and the student got close when she tutored him. According to a police report, Calvi taught the victim at John I. Smith K-8 Center and she later began tutoring the student at his home. In March, the allegations of a sexual relationship between the pair was reported to a principal and school resource officer at J.C. Bermudez Sr. High School, which is on the same campus as the K-8 Center.
- Officers found extremely inappropriate photos on the victim’s phone. During the investigation, Valdes reported that officers found “photographs that were certainly inappropriate, that indicate that there was in fact an inappropriate relationship.” There were nude photos of the two together as well as a WhatsApp thread in which they told one another they loved each other. There was also audio of the student telling another person to deny knowing about the relationship and further evidence that Heiry Calvi let the student use her credit card.
- Miami-Dade County Public Schools released a statement following Calvi’s arrest. “Miami-Dade County Public Schools (M-DCPS) is disturbed by today’s arrest involving inappropriate employee behavior,” it says. “When the district was apprised of these allegations in March, the employee was immediately reassigned to a non-school site location. The district will begin employment termination proceedings and will ensure the individual is prevented from seeking future employment with this school system. M-DCPS will continue to review its employee trainings to ensure that our workforce is fully aware of the district’s professional expectations of them and their ethical obligation to safeguard children.”
- Following her arrest, Heiry Calvi is now facing serious charges. Those charges include lewd and lascivious battery, electronic transmission harmful to minors, unlawful use of a communication device, child neglect, and offenses against students by authority figures. There was also a charge of possession of a firearm on school property as she had a Glock 43 9mm handgun in her car trunk which she claimed belonged to her husband and was always in the vehicle.
