Convicted Kohl’s Theives Request Lesser Charge Since Stolen Items Were On Sale And They Had Coupons

Two Colorado men who were convicted for the theft of more than $2,000 worth of merchandise from a Kohl’s store in Parker asked the judge to reduce their charges since the items they stole were on sale and they had coupons, the 18th Judicial District revealed. It truly does take all kinds!

The men were dubbed the “KitchenAid Mixer Crew” because of their haul.

Michael Green, 50, and Byron Bolden, 37, not only stole expensive Kitchen Aid appliances from the Kohl’s store but also brand-name clothes and shoes.

The pair were formally sentenced in December 2023 after they were convicted for their crimes, but the value of the items they stole made a big difference to their sentencing.

Their lawyers came up with a unique request.

In the state of Colorado, theft of merchandise worth less than $2,000 is considered a misdemeanor, but given that their total came to $2,094.98, they were in felony territory.

So, their defense attorneys argued with a jury that because some of the items the men stole were on sale and they had coupons, the actual amount — had they paid, of course — would have taken them under the $2,000 limit. However, given that they stole the items, prosecutors insisted that didn’t count.

“Just because an item is ‘on sale’ doesn’t mean it’s free to steal, and these defendants now get to think about this lesson in jail and prison,” District Attorney John Kellner said in a news release, per Denver 7. “Retailers in our community are fed up with theft and my office will actively prosecute these offenders.”

Needless to say, their request fell on deaf ears.

Green received 15 months in prison while Bolden got 90 days in jail with credit for time served and 18 months of probation.
